EU Regulation 1875/2006 – Entry Summary Declaration (ENS)

Dear Valued Customer,
We would like to provide an update on the above following our Advisory notice of 28 June 2010.
APL is progressing with National Customs Authorities to ensure that our systems are able to exchange required data with the Customs organizations according to their time lines.
We would like to remind you of the information you must include in your shipping instructions in order for us to submit the ENS:
• Full name and address of shipper and consignee
• Full name and address of notify party where goods are carried under a negotiable “to order” B/L
• EORI Number for parties to the bill of lading, if available
• Container number
• Goods description (general terms for example “consolidated cargo” or “general cargo” cannot be accepted, please see the attached list of examples of unacceptable and acceptable cargo descriptions)
• First six digits of the HS code
• Number of packages
• Package type description
• Cargo gross weight
• Seal number
• UN dangerous goods code where applicable
• Method of payment in case of prepaid, for example “payment in cash", “payment by cheque” or “electronic credit transfer”.
The ENS must be submitted to the National Customs Authority of the first European port call of the vessel. The ENS is required to cover all cargo on the vessel even if it remains on the vessel for subsequent ports outside of the European Union.
To comply with the regulations and obtain clearance for loading 24 hours prior to the start of vessel operations, we will be publishing on our web site the documentation cut-offs for each service by the load port. These will be available during the 1st week of December.
If you make your own entry summary declaration, written approval from APL will be required; which we would grant subject to the provision for such approval in APL’s tariff rules.
While the regulations allow for penalties to be applied for non-compliance to the regulation, no penalties have been announced by the European Union. It is expected that penalties will be determined by each Customs Authority individually.
We will continue to provide updates as the implementation date for vessels commencing their voyage after midnight 31 December 2010, approaches.
