2 Oct 2024 Dear Valued Evergreen Customers and Partners: Following the declaration of a total work stoppage at US East and Gulf Coast ports by the International Longshoremen's Association (ILA), Evergreen Line has announced it has invoked the Force Majeure clause of affected contracts and cargo bills of lading. For reference, the definition of Force Majeure, as provided within Evergreen bills of lading, is as follows: "Force Majeure shall include, but not be limited to, work stoppages, civil commotion, strikes, accidents, casualties, lockouts, fire, transportation disasters, acts of God, governmental restraints (including governmental import restrictions and voluntary quotas arising from the threat of governmental restraints), war or hostilities, embargoes or other similar conditions." This ILA strike, as a Force Majeure event factually, under the law and the concerned Evergreen Line contracts, has and is preventing Evergreen Line's ability, along with many others in a similar position, to serve those regions and perform its duties as anticipated. Affected parties are therefore notified that Evergreen Line recognizes this catastrophe as such a Force Majeure event and claims all its rights under contract and/or under general maritime and common law. Once this strike has passed, Evergreen Line will advise of that change in status, however it should be expected that port congestion and slowdowns will be likely upon resolution of the labor dispute.
